In accordance with the Digital Millennium Copyright Act (DMCA), Steve's Hardware has adopted the following policy to respond to claims of copyright infringement. We reserve the right to:
- Block access to, or remove, any content we believe in good faith to infringe upon copyrighted material distributed through our services—whether by users, affiliates, advertisers, or content providers.
- Terminate the accounts of users who are deemed repeat infringers.
Use of the Steve's Hardware website and services is governed by our [Terms of Service], which incorporate this Copyright Dispute Policy. Any capitalized terms not defined here have the meanings set out in the Terms of Service.
1. How to Report Copyright Infringement
If you believe that material available through our services infringes your copyright (or that of someone you are authorized to represent), please send a written DMCA notice to our Designated Agent with the following required information:
- Your physical or electronic signature, as the copyright owner or an authorized representative.
- Identification of the copyrighted work you claim is being infringed.
- A detailed description of the allegedly infringing material, including its specific location on our website or services (e.g., URL or relevant section).
- A statement, made in good faith, that the use is not authorized by the copyright owner, their agent, or the law.
- Your full contact information: name, physical address, phone number, and (if available) email address.
- A statement, under penalty of perjury, that the information provided is accurate and that you are authorized to act on behalf of the copyright owner.
2. Upon Receipt of a Valid DMCA Notice
Once we receive a complete and valid DMCA takedown notice, Steve's Hardware may:
- Remove or disable access to the infringing material.
- Notify the affected user or content provider of the takedown.
- At our sole discretion, suspend or terminate accounts of repeat offenders.
3. Submitting a Counter-Notice
If you believe that content was removed or disabled in error, you may file a counter-notice with our Designated Agent. Your counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that was removed or restricted and the location where it appeared before takedown.
- A statement, made in good faith, that the content was removed due to a mistake or misidentification.
- Your name, address, telephone number, and email (if available).
- A statement that you consent to the jurisdiction of the courts in your district (or if outside the UK, the jurisdiction where Steve's Hardware is located), and that you accept service of process from the original complainant.
4. After a Valid Counter-Notice
If a valid counter-notice is received, Steve's Hardware may:
- Forward the counter-notice to the original complaining party.
- Inform them that the removed material may be restored after 10–14 business days unless legal action is taken to prevent it.
If no legal action is initiated within that period, we may, at our discretion, reinstate the content.
